The 120th Congress: What the 2026 Midterms Mean for Firearms Policy

NBC News and Fox News project Democrats will hold majorities in both the House and the Senate in January. Who won, who lost, every newcomer's firearms record and what it means for pending gun bills.

By Firearms Almanac

Results as of 4:04 a.m. CT, Wed., Nov. 4, 2026. Uncalled races are noted as UNCALLED and listed in the methodology section. Race calls are from the NBC News and Fox News decision desks; we never project a winner ourselves.

Summary#

  • Senate: 54 seats for Democrats (including two independents who caucus with them) and 44 for Republicans, with 2 races uncalled (Alaska and Mississippi). Before the election it was 53 R, 45 D, 2 I (senate.gov).
  • House: 232 Democrats and 144 Republicans in called races, with 59 of 435 races uncalled. Before the election it was 218 R, 214 D, 1 I, with 2 vacancies (Clerk of the House).
  • Majority control: NBC News and Fox News project Democrats will hold majorities in both the House and the Senate in January, based on races they had called as of 4:04 a.m. CT Nov. 4. No state has certified results. The Associated Press has also reported Democrats won both chambers (AP); we have not independently verified AP's race-by-race calls. The called totals above would clear 51 Senate seats and 218 House seats if the calls hold (NPR, based on AP calls).
  • Incumbents defeated in the general election (called races): 23 in the House and 4 in the Senate.
  • Seats that changed party (called): 7 in the Senate and 28 in the House, all to Democrats.
  • Governors: 34 of 36 races called (22 D, 12 R). Five went from Republican to Democratic control: Georgia, Iowa, Nevada, Ohio and Texas. None went the other way. Alaska and Kansas are uncalled (see section 7).
  • State legislatures (preliminary): Ballotpedia reports Democrats gained control of at least five chambers, and Republicans gained none (see section 8).
  • Firearms takeaway: The House-passed H.R. 2189 and H.R. 1041 are pending in the Senate. Bills not enacted before the 119th Congress ends (no later than noon Jan. 3, 2027) expire and would have to be reintroduced in the 120th Congress. The SHORT Act's Senate sponsor, Sen. Roger Marshall (R-KS), lost his race, and committee leadership on Judiciary, Finance and Ways and Means will change hands when the new majorities organize in January.

1. The new makeup of Congress#

| Chamber | Before (sourced) | After, called races | Change | Uncalled | Vote leaders in uncalled races (not calls) | |---|---|---|---|---|---| | Senate | 53 R / 45 D / 2 I (senate.gov) | 54 D (incl. 2 I) / 44 R | D +7, R −7 (called) | 2 | AK Senate: Dan Sullivan (R), MS Senate: Scott Colom (D) | | House | 218 R / 214 D / 1 I / 2 vacant (clerk.house.gov) | 232 D / 144 R | see flips below | 59 | 30 D, 29 R |

  • A Senate majority takes 51 seats, or 50 plus the vice president's tie-breaking vote. A House majority takes 218 of 435.
  • Senate totals add this year's called winners to the 65 senators not on the ballot (31 R, 32 D, 2 I), as also shown in NBC News' balance-of-power tally.
  • Vote leaders are shown only to describe the count. A leader is not a winner until a decision desk calls the race.

5. Federal firearms policy outlook#

Where things stand going in (status from congress.gov, Oct. 30, 2026):

  • NFA tax: $0 since Jan. 1, 2026, for suppressors, SBRs, SBSs and AOWs under P.L. 119-21, §70436, amending 26 U.S.C. 5811 (law.cornell.edu); the $200 tax still applies to machine guns and destructive devices (CRS IF13111). That is current law and does not change with these results.
  • Under guidance effective Oct. 9, 2026, ATF says it "will not enforce the requirements for individuals to apply and receive ATF approval before making or transferring short-barreled rifles, short-barreled shotguns, suppressors (silencers), and certain other concealable firearms known in the law as 'any other weapons,'" and "will not enforce the NFA's registration, tax-stamp or related requirements for those covered items" (ATF guidance; ATF Oct. 9 release). The guidance does not supersede state and local laws that restrict NFA firearms. This is an ATF enforcement policy; the NFA statute's requirements have not been repealed.
  • Machine guns and destructive devices are unaffected; the $200 tax and full NFA requirements still apply to them.
  • Passed the House, pending in the Senate: H.R. 2189, less-than-lethal devices, 233–185 (congress.gov); H.R. 1041, Veterans 2nd Amendment Protection Act, 216–201 (congress.gov).
  • Reported but no floor vote: H.R. 38, concealed-carry reciprocity (congress.gov).
  • Referred only: the Hearing Protection Act (H.R. 404 / S. 364) and the SHORT Act (H.R. 2395 / S. 1162) (H.R. 404, H.R. 2395).
  • Bills not enacted before the 119th Congress ends (no later than noon Jan. 3, 2027) expire and would have to be reintroduced in the 120th Congress.

What the results change, in documented terms:

  • Agenda control moves. In January, Democrats will set the floor schedule in both chambers and chair Judiciary, Finance and Ways and Means, the committees that handle the bills above. Whether any of them gets a hearing or a vote will be up to the new majorities.
  • The lame duck is the last window for this Congress's bills. The current Republican majorities sit until the 119th Congress ends (no later than noon Jan. 3, 2027). As of publication we found no scheduled Senate action on H.R. 2189 or H.R. 1041. Both would also face the Senate's 60-vote cloture threshold for most legislation, which still applies (senate.gov); a proposed rules overhaul by Sens. Merkley and Daines has not been adopted (The Hill).
  • Sponsors and supporters leaving. Sen. Roger Marshall, the SHORT Act's Senate sponsor, lost. (projected by NBC News and Fox News as of 4:04 a.m. CT; no state has certified results). Rep. Richard Hudson (R-NC), sponsor of H.R. 38, lost to Richard Ojeda (D) in NC-9, as projected by NBC News as of 4:04 a.m. CT (Fox had not called the race). Projections below are by NBC News and Fox News as of 4:04 a.m. CT; no state has certified results. Rep. Ben Cline (HPA, VA-6): re-elected, called by NBC News, Fox News. Rep. Andrew Clyde (SHORT Act, GA-9): re-elected, called by NBC News, Fox News. Rep. Mike Bost (H.R. 1041, IL-12): re-elected, called by NBC News, Fox News. Rep. Scott Fitzgerald (H.R. 2189, WI-5): re-elected, projected by NBC News (NBC race page, checked 5:58 a.m. CT Nov. 4); not certified.
  • Of the 23 House incumbents who lost, 20 had voted for H.R. 1041 and 21 for H.R. 2189.
  • Who is arriving. Among the 95 newcomers in called races, 60 hold an NRA-PVF F grade and 44 were endorsed by Giffords, Everytown or Brady PAC; 28 hold an NRA-PVF A-range grade. Those are pre-election ratings, not votes, and a rating does not tell us how a member will vote on a specific bill.
  • Judicial confirmations. Before the election, the NRA argued that Senate control would shape which federal judges are confirmed (American Rifleman, "A Midterm Case for Freedom"). Judiciary will now be chaired by a Democrat, which matters for any vacancy President Trump fills in the last two years of his term.

Open questions we'll be watching (none of these is a prediction):

  • Will the Senate take up H.R. 2189 or H.R. 1041 before the 119th Congress ends (no later than noon Jan. 3, 2027)? We found no announcement either way.
  • Will the Hearing Protection Act, SHORT Act or concealed-carry reciprocity be reintroduced in the 120th Congress, and will a Democratic-chaired Judiciary or Ways and Means committee schedule them? No new chair has said.
  • Will background-check bills like H.R. 8 (passed the House in 2021) return? We found no statement from incoming leadership yet.
  • Does the new Congress revisit the $0 NFA tax or ATF's Oct. 9 enforcement decision? Neither depends on the election, and we found no statement from incoming leaders about either.

We will update this section with attributed statements from lawmakers, NRA-ILA, GOA, Giffords, Everytown, Brady and CRS as they come out.

Kansas (open seat; Laura Kelly, D, is term-limited, per Ballotpedia): Holscher (D) leads 50.3% to 49.7% with about 98% counted. A leader is not a winner.
  • Why it matters for firearms policy: Governors sign or veto state gun bills. In Georgia, Iowa, Ohio and Texas, the change would also end a single-party Republican "trifecta" (governor plus both legislative chambers), according to Ballotpedia's preliminary analysis, pending uncalled races and certification; results are not certified. We haven't reviewed which state firearms bills are pending in those states, so we aren't predicting outcomes.

8. State legislatures (preliminary)#

Preliminary. Most chambers are still uncalled.

  • Ballotpedia (results as of 1:30 a.m. ET / 12:30 a.m. CT) reports, in its preliminary analysis pending uncalled races and certification, that Democrats gained control of five state legislative chambers: the North Carolina House, the Wisconsin Senate, the Wisconsin Assembly, the Pennsylvania Senate and the Minnesota House. Before the election, the Minnesota House was operating under a power-sharing agreement, so four of the five were Republican-controlled. Republicans hadn't gained control of any chamber.
  • Ballotpedia's results summary page lists six chambers moving to Democrats as of 2:22 a.m. ET (1:22 a.m. CT), but it doesn't name the sixth in the text we reviewed. Control of 35 to 37 of the 88 chambers on the ballot was still uncalled.
  • Local reporting matches the named chambers: WPR (Wisconsin Senate 18–15 and Assembly 53–46, unofficial AP results), the News & Observer (North Carolina House) and Spotlight PA (Pennsylvania Senate, with Democrats claiming control).
  • Ballotpedia's preliminary analysis projects new Democratic trifectas in Minnesota, Pennsylvania and Wisconsin, pending uncalled races and certification. Under a trifecta, one party can pass state gun legislation without needing votes from the other party.

9. Races we flagged before the election#

10. Methodology, uncalled races and sources#

  • Results as of 4:04 a.m. CT, Wed., Nov. 4, 2026. A race is reported as decided only when a major news decision desk has projected it and no desk disagrees. This run used the NBC News Decision Desk and the Fox News Decision Desk; each race links to the desk that called it. AP's race-by-race calls could not be fetched automatically for this draft; AP's report that Democrats won both chambers is here. Decision Desk HQ's results site blocked automated access and was not used.
  • Desk disagreements: none in this run.
  • Vote leaders in uncalled races are listed for context only and are not projections.
  • Uncalled races (2 Senate, 59 House, plus 5 non-voting delegates):
  • Senate: AK Senate ((72.41% reporting; Dan Sullivan (R) leads, not a call); MS Senate ((95.62% reporting; Scott Colom (D) leads, not a call)
  • House: AK-AL (72.3%), AZ-01 (71.02%), AZ-02 (78.8%), AZ-05 (75.1%), AZ-06 (74.01%), AZ-08 (72.82%), CA-04 (40.62%), CA-07 (41.1%), CA-11 (51.42%), CA-13 (56.2%), CA-14 (51%), CA-22 (51.92%), CA-23 (55.1%), CA-34 (69.01%), CA-40 (41.1%), CA-47 (59.1%), CA-48 (50.4%), CO-03 (80.93%), CO-04 (83.1%), CO-05 (72.13%), FL-07 (99%), FL-09 (99%), FL-13 (99%), FL-26 (99%), FL-27 (99%), LA-06 (99%), ME-02 (83.84%), MI-04 (86.9%), MI-07 (96.2%), MI-10 (79.21%), MN-01 (98.7%), MT-01 (78.3%), NE-01 (89.34%), NV-02 (85.9%), NJ-02 (89.2%), NY-01 (86.33%), NY-02 (78.23%), NY-04 (85%), NY-17 (60.9%), NY-21 (81.2%), NC-03 (99%), NC-05 (99%), NC-07 (99%), OH-10 (98%), SC-01 (98.91%), SC-02 (99%), TN-04 (99%), TN-09 (99%), TX-02 (92.6%), TX-05 (25.63%), TX-09 (71.23%), TX-22 (92.43%), TX-27 (98.22%), TX-32 (28.2%), TX-38 (90.7%), UT-02 (67.82%), VA-05 (97.6%), WA-04 (57.8%), WA-05 (57.4%)
  • Ranked-choice: Alaska and Maine use ranked-choice voting for federal races and can take longer to finalize. Several uncalled districts are in states that count mail ballots for days, including California, Arizona, Washington, Nevada and Colorado.
  • Firearms records: NRA-PVF grades (nrapvf.org); GOA endorsements; Giffords, Everytown and Brady PAC endorsements; recorded roll-call votes from the House Clerk and Senate. Each item is linked where it appears.
  • We do not infer a position from party affiliation. Candidates with no rating, endorsement, vote or statement on record are listed as "No rating, endorsement or vote found."
  • Pre-election makeup and ratings: senate.gov, clerk.house.gov, Cook Political Report, Inside Elections and Sabato's Crystal Ball.
  • Bill status: congress.gov pages linked above; CRS IF13111 on the NFA tax.

Firearms Almanac reports on firearms law and policy. This article is general information, not legal advice, and it doesn't endorse any candidate or party.
